SDS Terms & Conditions
Wherever possible our terms and conditions are written in plain English and are designed to be fair to both the parties involved, yourself (the trainee) and ourselves (the trainers).
If you have any doubt as to the meaning or understanding of them, or you feel they are unfair please, contact Sharmas Driving School (SDS) prior to any training course or Driving Lesson. It is your responsibility to ensure that you fully understand them and any financial or other implication they may hold for you.

- You have the right to cancel your lessons at any time up to 4 hours before the time of the lesson, and you are entitled for a refund of any money paid in advance. Cancellation should only be made via the telephone numbers given above. 24 hour notice required if cancelled via e mail or in writing. We request you give us as much prior notice as possible but we do not specify a timescale other than before the lesson is due to commence.
- You are given the right to a full refund of any fees paid in advance if, after your first lesson you are dissatisfied in any way with any aspect of the driving lesson. If you just feel learning to drive is not for you, you need not give a reason. If possible, we would like to know the reason for dissatisfaction or cancellation, for us to learn and improve our service to our customers. In other words you can decide after your first lesson as to whether you want to continue driving with us even if you have paid in advance.
- After the first lesson, SDS asks for 24 hrs notice to cancel or change any future driving lesson appointment. If you do not give us 24 hrs notice at the instructor’s discretion, you may be charged the full cost of the lesson or have the full cost deducted from any advance payment held on your behalf. This penalty clause is waived for clients with pre - school age children, anyone who has notified us in writing and agreed by the Jenny Hayes School of Motoring beforehand of an illness or condition such as late stage pregnancy, diagnosed physical disability etc, which may from time to time affect your ability to drive a motor vehicle at short notice. This does not apply to ailments such as hangover tiredness or ailment of a minor nature which will affect your ability to drive.
- Any disagreements should either be taken up with the driving instructor or with the school itself. We do however accept responsibility for instructors upholding our code of practice at SDS.
- Our contract is made with the parent or guardian of under 18 year old and wherever possible we explain directly to the responsible adult. However, this is not always possible by the very nature that the legal age to learn to drive starts at 16 years of age and that the speed of booking a lesson is usually important to the person booking the lesson. In these instances, we ask if the trainee has permission to book the lessons from their guardian or parent.
- These terms and conditions only apply to standard driving lessons and block booking of standard driving lessons.
- A driving lesson may/ could be cancelled at short notice due to adverse weather or road conditions by your trainer. Your training will be rescheduled without any charge and you will not be entitled to any compensation for travelling or otherwise.
- You must be able to read a number plate at 20.5 m and produce your learner driving licence or any other Licence - either photographic id or the old paper style licence at your first in - car training session. If you cannot do either of these things, you will not be allowed to commence in - car training until you can do so, and you will be charged for the cancelled training session.
- You must be fit and in a proper state to drive a motor vehicle. In case, the trainer feels you are not fit to drive but not limited to illness, tiredness, attitude, alcohol or drugs, your trainer in concern for health and safety may refuse to train you or may at any time terminate your training session and you will be charged for the driving lesson.
- In extreme circumstances, if the instructor is being threatened or is subject to verbal or physical abuse, you will be asked to leave the vehicle. Irrespective of where you are, the training will terminate at that point and the remaining course will be cancelled and no money will be refunded. If you are under 18 years of age and we ask you to leave the vehicle, we will contact your parents or responsible adult and ask them to pick you. We will ask you to wait at the tuition vehicle until they arrive, however we cannot be held responsible if the trainee refuses to wait.
- All training will be conducted in the trainer’s car which is mechanically safe and functioning to conduct the lesson. The car will be clean, presentable inside and out, will be fitted with dual brake, speed (in manual cars clutch) and interior mirror. The car will have fully comprehensive car insurance which covers all drivers, including the LTO ( Vic Roads Licenced Testing Officer) and trainee during training and the VicRoads Car Driving tests. This includes legal cover.
- The company has own public liability and professional indemnity insurance policy.
- Learner/ Clients must be in possession of a current valid Australian Learner, Red Provisional, Green Provisional or full driving licence.
- Clients must be capable of learning to drive in a standard Automatic or manual category B car.
- Clients must act in a mature and responsible manner whilst learning to drive; otherwise the lessons may be cancelled without any refund of fees.
- Clients should declare any learning or physical disability which would affect their capability to successfully learn to drive.
- Refunds will be made within 30 days and can only be refunded to the original source of funding.
- In the event of dispute or disagreement between your instructor and yourself, the decision of Sharmas Driving School will be final and binding. This does not override any rights you may have in law.
- Wherever possible you will receive driving lesson / tuition from the same instructor. However, we reserve the right to change instructors at any time due to sickness or any unforeseen circumstances.
- Free lesson is only provided once the learner is able to get a valid Learner Id from Keys2Drive to provide it to his/her Instructor.
Both parties should adhere to all of the above which forms an integral part of these terms and conditions.
